PUTRAJAYA (July 21): The Federal Court has fixed Sept 21 to hear the application by former premier Datuk Seri Najib Razak and his son Datuk Mohd Nazifuddin Najib to stay the summary judgements that require them to pay RM1.69 billion and RM37.64 million, respectively, to the Inland Revenue Board (IRB).

The date was fixed by Federal Court deputy registrar Suhaila Haron on Thursday (July 21) during case management of the application.

Lawyer Wee Yeong Kang from Messrs Shafee & Co appeared for Najib and Nazifuddin, while revenue counsel Ainur Mardhiah Ramli represented the IRB.

The summary judgements against Najib and Nazifuddin were awarded in the High Court in July 2020 by Justice Datuk Ahmad Bache and Justice Datuk Ahmad Zaidi Ibrahim (now a Court of Appeal judge).

The Court of Appeal upheld the decisions in October 2021, but granted an interim stay of the summary judgements.

In May this year, Najib and Nazifuddin obtained leave from a three-member Federal Court bench, led by Chief Justice Tun Tengku Maimun Tuan Mat, to have the merits of their appeal be heard.

Nine questions of law were posed before the apex court bench for determination.

In addition to this income tax case, Najib has also been convicted on all seven charges in his SRC International Sdn Bhd case and sentenced to 12 years in jail and a fine of  RM210 million. His sentences were upheld by the Court of Appeal, and his final appeal at the Federal Court is set to be heard on Aug 15.

Najib has also been charged with abuse of power and money laundering in relation to 1Malaysia Development Bhd (1MDB). He has also claimed trial in an audit tampering case relating to 1MDB.
