KUALA LUMPUR (Oct 26): The applications to strike out two lawsuits filed by Tan Sri Jamaluddin Jarjis’ mother over alleged fraud committed against her during the administration of the late minister’s assets and RM21 million cash kept in various banks will be heard on Dec 9.

The dates were fixed following case management on Monday.

In the first suit, Aminah Abdullah, 86, is suing the deceased’s eldest daughter Nur Anis and son Ikhwan Hafiz. Also named as defendants are law firm Wong Lu Peen & Tunku Alina, Judicial Commissioner Liza Chan Sow Keng, and Commissioner for Oaths Tengku Fariddudin Tengku Sulaiman.

In the second suit, Aminah named Nur Anis and Ikhwan Hafiz as defendants to recover and claim RM21 million that is kept in Jamaluddin's bank accounts.

The striking out applications were filed by Nur Anis, Ikhwan Hafiz, Wong Lu Peen & Tunku Alina and Chan.

The hearing date was confirmed by Aminah’s lawyer Wan Zafran Pawancheek and Ikhwan Hafiz’s counsel K Shanmuga when contacted separately by The Edge.

They said High Court Justice Datuk Rozana Ali Yusoff will hear both applications on the same day.

The next case management is fixed for Nov 30 before deputy registrar Nor Afidah Idris.

The court had also on Monday allowed Aminah's application for extension of time to admit various affidavits and pleadings in reply as her solicitors previously claimed that this was delayed due to the Covid 19 pandemic.

“Her Ladyship ruled the documents admissible, and allowed the plaintiff’s (Aminah) application with no orders as to costs,” Wan Zafran said.

The two grandchildren and other defendants in the first suit had filed their striking out application on the grounds that Aminah is incapable of administering their father's estate and that Jamaluddin's half-brother Najeb Ali is allegedly using Aminah in a proxy fight.

They further claimed that the applications amounted to a duplicity of legal action following the initial suit filed in 2019.

Aminah in that suit sought a declaration that she was Jamaluddin’s lawful mother, and hence is also a beneficiary of his estate and had an interest in the shares of Rantai Wawasan Sdn Bhd, Alpine Motion Sdn Bhd and Ivory Insights Sdn Bhd.

The High Court allowed the declaration that Aminah is entitled to be a beneficiary to the former minister’s estate. However, it only allowed Aminah a claim on Rantai Wawasan Sdn Bhd as part of her deceased son’s estate.

Subsequently, Jamaluddin’s children obtained a conditional stay from the court on the ruling pending an appeal on the decision at the Court of Appeal.
