PUTRAJAYA (July 27): It seems that the records of appeal for former Federal Land Development Authority (FELDA) chairman Tan Sri Mohd Isa Abdul Samad's RM3.09 million graft charges over the authority's purchase of Merdeka Palace Hotel & Suites between 2014 and 2015 are not ready yet.

Hence, the Court of Appeal has to fix another case management date on Sept 8, when it will possibly decide on a date for the hearing of Isa's appeal, along with the prosecution's cross-appeal over the acquittal of Isa of the criminal breach of trust (CBT) charge in relation to the acquisition of the property, according to Deputy Public Prosecutor Afzainizam Abdul Aziz.

This was decided following case management on Wednesday (July 27) before Court of Appeal senior assistant registrar Tan Chai Wei.

Usually, after the records of appeal are ready, both the defence and prosecution can file the petition of appeal stipulating the grounds of appeal.

Isa has been convicted of graft and sentenced to six years in jail and a fine of RM15.45 million, on Feb 3 last year, by Justice Datuk Mohd Nazlan Mohd Ghazali, who is now a Court of Appeal judge.

Justice Nazlan, however, acquitted him of the CBT charge at the end of the prosecution's case, resulting in the prosecution cross-appealing the acquittal.

Isa, a former Umno vice-president, was accused of receiving the RM3.09 million bribe from a former director of Gegasan Abadi Properties Sdn Bhd, between July 21, 2014 and Dec 11, 2015. Gegasan Abadi previously owned the hotel before letting it go to FELDA.
